These terms and conditions outline the rules and regulations for the use of Zenup Health’s Website, located at zenuphealth.com.

By accessing this website we assume you accept these terms and conditions. Do not continue to use Zenup Health if you do not agree to take all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of in. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Teleconsultation or Diagnostic Services:

Zenup Health enables you to connect with psychologists, doctors, registered medical practitioners, and diagnostic service providers through various modes available on its app and website for availing various services and allows you to buy various products available on its Platform.

You should know that that Zenup Health collects your information for the provision of the Services and allied/ancillary purposes, which may be shared with the various registered practitioners, who shall be providing eligible services. Information to be collected inter alia includes, name, emergency contact’s name and contact number, address, medical history, email, contact number etc.

You must know that Zenup Health is not involved in providing any healthcare services and therefore is not responsible for any interactions between you and such practitioners or for availing any medical services through this platform in any manner whatsoever.

Booking and Payment:

Booking for various healthcare services made available by Zenup Health shall be done at its app or website which may have third party link and generally acceptable payment mechanism. You agree that you shall not hold Zenup Health liable or accountable for any payment made for any product and services, however, Zenup Health will assist you in case of any difficulty or for required assistance.

Cancellation and Refund:

You should know that cancellation and refund for any services purchased is governed by the terms of such product catalogue. For availing healthcare services, cancellation or rescheduling for the booking can be done 24 hours prior to the appointment. Refund process will take upto ( 5-7 ) working days.

Parties:

Sessions at Zenup will be conducted between you (“Client”) and a “Psychologist / Psychiatrist” specifically to address the Client’s mental health concerns (“Services”). The Client expressly agrees to conducting online sessions by Zenup on available video meeting platforms and/or offline sessions which will be conducted in-person. The Client understands that Online Sessions on Video meeting platforms has its own limitations as compared to in person sessions and some details could potentially be missed out despite the Psychologists’ / Psychiatrists’ best efforts. With due knowledge of such limitations the Client expressly consents to the Online Sessions on Video meeting platforms.

Client:

(a) is above the age of 18 years; OR (b) the client is under 18 years of age and this consent form is filled by the parent through their email address as parental consent is mandatory per company policy if the the client is a minor; AND (c) understands and agrees to the Terms mentioned below.
 

Crisis:

Zenup is not a crisis center and has finite operating hours. If the Client’s situation involves a life threatening emergency and / or requires urgent physical care, the Client must visit a hospital for assistance.

Client Sessions, Records, and Confidentiality:

Neither of the parties (patient/patient’s party or the psychiatrist) will record audio or video, without prior explicit consent. Covert recordings (audio or video) are illegal since everyone being recorded must consent to be recorded. “Client Information” means all information provided by the Clients to Zenup and / or the Psychologist / Psychiatrist, including all medical health records, personal information, sensitive information, records of the sessions, and any communication between the Psychologist / Psychiatrist and the Clients. Written documentation of Client Information may include a referral form, notes from initial screenings, a provisional diagnosis, a treatment plan, goals and recommendations, and progress notes for every visit. The Clients consent to the use and retention by Zenup of Client Information. Zenup will take best efforts to keep Client Information, including communication between the Client and Psychologist / Psychiatrist at Zenup during the session confidential. The Clients are entitled to access Client’s basic medical health record (which includes demographic information, diagnosis, and treatment plan) by requesting it in writing from Zenup. Zenup may retain Client Information for the purpose of recordkeeping and analysis. Our professionals may internally share certain Client Information for supervision and assessment purposes. Confidentiality is of utmost importance whilst sensitively dealing with each of our Clients and their families. However, disclosure of Client Information is mandatory in the event of any perceived risk to the Client or from the Client, or for any reason as may be necessary to disclose by law. The Client understands that despite safety measures taken there are chances of breach in security in technology. Client hereby agrees not to hold Zenup, its Psychologist, Psychiatrist, Employees, agents and affiliates for any breaches of confidentiality of his/her personal identifiable or sensitive information or data or any data or information pertaining to the mental health and services to the Client by Zenup due to Sessions conducted on Video meeting platforms without any deliberate attempt on part of Zenup, its Psychologists, Employees, agents and affiliates.
 

Length and Frequency of Sessions:

The length of the sessions is upto 60 minutes with the Psychologist and upto 30 minutes with the Psychiatrist. To avail of the Services for more than the given time, Client will be required to book a separate appointment for a new session and will be charged accordingly. Frequency of sessions is decided according to the needs and the unique situation of each Client.

Being Late for a Session:

If the Client arrives or connects late for an appointment, the duration of the appointment may be shortened by the amount of time the Client came in late, in interest of subsequent sessions. When the Client arrives, the Psychologist / Psychiatrist will make use of the time that is available, and may not be able to extend the session time due to the next Client’s appointment or other time commitments unless otherwise condoned by the psychologist / psychiatrist at their discretion.

Payment

Clients are expected to pay the standard fee before each session, unless other arrangements have been made in advance. There is an option of making the payment by cash, credit card, or etransfer/UPI. Zenup does not offer a refund of any payment made by clients subject to the provisions laid in bullet 9 “Cancellation Policy and Missed Appointments”. Zenup shall not be entitled to refund or repay any amount to the Client paid towards Client’s treatment opted under a package, in case the Client discontinues with the treatment without completing the entire course of the package/ sessions. Home visits are charged differently than appointments for sessions at Zenup. Please inquire about home visit charges with us.

Insurance

Zenup does not have a cashless facility and therefore does not provide direct billing; however, receipts can be provided so that Clients may submit their claim for reimbursement from their respective insurance providers. If the insurance provider requires clinical notes, the Client will be asked to sign a ‘Disclosure Consent Form’ to disclose information.

Cancellation Policy and Missed Appointments:

Clients are requested to inform Zenup at the earliest if they are unable to keep an appointment. An appointment time is especially reserved for the Client; therefore, Zenup requires an advance notice of at least 24 hours for cancellations or changes in the scheduled appointments. If an appointment is cancelled with less than 24 hours’ notice, or if the Client fails to show up, the Client will be charged for the appointment. Emergency circumstances may be considered where Zenup, at its discretion, will allow refund of fees if sessions are canceled within 24 hours of the scheduled session. Zenup shall reschedule an online Session in case any Sessions are disrupted due to any technical concerns at Zenup’s end. It shall be the responsibility of the Client to ensure all arrangements including IT hardware, software, internet, power etc. requirements at their end to connect with Zenup on an agreed video meeting platform. The Online Sessions shall be deemed completed even in case the Client is unable to avail the Sessions partly or fully, for technical issues at Clients end.

Right to Deny Service:

Zenup reserves the right to deny or discontinue Services with the Client, in case the Client and / or parent / guardian / misbehaves or misconducts or mistreats any personnel of Zenup or any person / staff associated with Zenup or creates an unhealthy atmosphere in the vicinity of Zenup which is likely to affect the goodwill of Zenup. The Client has expressly given consent without having been subjected to coercion, undue influence or intimidation to undertake treatment at Zenup, after adequately understanding and considering the information and procedure for undergoing treatment along with an understanding of anticipated risks involved, if any. Hence, the Client shall not hold Zenup liable for any act or omission which shall directly or indirectly affect the health of the Client. The Clients agree to defend, indemnify and hold harmless Zenup, from and against all liabilities, claims, or losses, and acknowledge that Zenup cannot be held liable for any claims arising out of use of the Services, violation of the Terms or violation of any third party right. These Terms shall be governed by the laws of India and any disputes arising out of the Terms shall be subject to the exclusive jurisdiction of the courts of Mumbai.
